Thailand's "Under Counter" Visa Problem

What it is, why it's more dangerous than ever, and how to protect your right to stay in Thailand legally.

What Is an "Under Counter" Visa?

In Thailand's expat and tourist communities, the term "under counter visa" refers to unofficial, informal, or legally questionable arrangements used by foreigners to extend or maintain their stay — operating entirely outside the proper immigration process. These practices are widely known, surprisingly common, and now the focus of a major government crackdown.

Common "Under Counter" Practices

💸
Paying Unofficial "Priority Fees" ❌
Some visa agents in Thailand offer to "fast-track" applications by paying unofficial fees to bypass standard requirements — such as proof of income, proof of enrolment, or financial thresholds. These payments are made under the table, often without the applicant's full knowledge. These practices are particularly prevalent in border provinces and popular tourist destinations like Phuket and Pattaya. The agent submits paperwork in Thai; the applicant never sees what was actually filed. When immigration flags the irregularity later, it is the applicant — not the agent — who faces deportation.
📄
Unregistered Agents & Falsified Documents ❌
Unregistered or illegitimate visa agents submit forged or fabricated supporting documents on behalf of applicants — fake bank statements, false employer letters, or fabricated proof of address. Applicants often remain unaware of what has been submitted in their name. The risk is enormous: if discovered during any future visa application or immigration check, the applicant is considered complicit, regardless of their knowledge, and can face entry bans, prosecution, or deportation.
🚗
Repeat Border Runs ❌
A "border run" involves leaving Thailand — typically to a nearby country — purely to re-enter and receive a fresh entry stamp, rather than applying for a legitimate long-stay visa. For years, this was a common workaround for digital nomads, retirees, and long-stay expats. As of November 2025, Thailand now limits visa-exempt entries to two per calendar year. Beyond that, re-entry can be denied outright at both airports and land border checkpoints. Immigration officers are trained to identify "border hopper" patterns in passport stamps.
🚌
Visa Run Package Tours ❌
In places like Phuket, Pattaya, and Hua Hin, a commercial industry has grown around organising group trips to the nearest border crossing — purely to take care of "visa formalities." These package tours often involve buses, minivans, or budget flights, and have been used by long-term residents to continuously renew short-term stays without ever holding a proper visa. This industry is now directly in the crosshairs of the Thai Immigration Bureau's enforcement activities.

Entry Denied After Two Visa Runs
Effective from November 2025, Thailand's Immigration Bureau enforces a strict limit of two visa runs per calendar year for those entering on visa exemption. After two entries without a justifiable reason or a proper long-term visa, re-entry is denied at both international airports and border checkpoints. This applies to consecutive tourist entries — meaning entering Thailand twice on visa exemption or tourist visa already counts as reaching the limit.
🔍
Enhanced Border Screening
High-risk border crossings — particularly Mae Sot and areas linked to scam compound activity — now have enhanced screening protocols. Foreigners on watchlists or with prior deportations are banned from re-entry. Immigration officers are systematically reviewing passport histories for patterns of repeated short-stay entries, and extensions are refused or revoked when a visa-run pattern is identified — followed by deportation.
📋
Stricter Extension Requirements
Visa exemption extensions are now capped at two per year: a first extension of 30 days, followed by a second of just 7 days. Foreign nationals entering via a land border cannot receive any extension at all. Same-day re-entries are not eligible for extensions under any circumstances. Provincial immigration offices have been directed to tighten the screening process and reject extension applications that show signs of intentional visa-run behaviour.

⚠ The Hidden Risk Most People Don't See

Many foreigners using informal visa agents have no idea what is being filed on their behalf. The agent submits paperwork in Thai, the applicant cannot read what was filed — and when immigration flags irregularities at a future application, it is the applicant who faces the consequences, not the agent. This can mean visa cancellation, deportation, and a permanent ban from entering Thailand — all for paperwork you didn't write and may never have seen.

Translation Services

Every Migrify application includes a fully certified Thai-language translation of your complete supporting documentation, submitted alongside your original application as standard — at no extra cost.

📋
What We Translate
Your entire application package — including financial statements, employment letters, proof of address, insurance documents, and personal declarations — is professionally translated into Thai and formatted to match Thai consular standards. Nothing is left untranslated, and every document is cross-referenced against the original to ensure complete accuracy.
Faster Processing for Consular Staff
Thai consular officers and immigration staff work primarily in Thai. Receiving a pre-translated application means they can review, verify, and process your documents immediately — without needing to pause, request clarification, or arrange their own translation. This significantly reduces the chance of your application being set aside or delayed in the queue.
Fewer Errors, Fewer Rejections
Mistranslated terms, incorrect formatting, or ambiguous phrasing are among the most common — and most avoidable — reasons for visa delays and rejections. Our in-country Thai language team ensures your documents are not just translated, but contextually accurate for the Thai immigration system, using the correct legal terminology expected by Thai consular offices.
🤝
Builds Confidence with Officers
A dual-language application signals professionalism and preparation. Consular officers are far more likely to process an application with confidence when the supporting evidence is clear, complete, and presented in their working language — leaving no room for doubt or misinterpretation on the officer's side.
Translation services are included as standard with every Migrify DTV application — because your visa should never be delayed by a language barrier.
